Initiating litigation proceedings in designs

Litigation proceedings can only be initiated after the design has been entered in the register. Any legal or natural person may initiate litigation proceedings by filing an application for removal of the design from the register. At the same time, a request for determination may be filed by the owner himself or by third parties.
