 Patent granted within 24 months of filing a patent application

Conditions for granting the patent within 24 months of the filing of the application

Patents may be granted for inventions that meet the conditions for patent protection (they are new, involve inventive activity and are capable of industrial application) and whose applicants request a priority search within 24 months of filing the patent application.

The Office shall grant a patent for the invention within the above period, provided that the following conditions are met:

  • a priority search has been carried out on the subject matter of the patent application,
  • the applicant shall, within 10 months of the filing of the application, file a request for early publication of the application and pay the relevant administrative fee,
  • the applicant shall, within 10 months of the filing of the application, file a request for a complete examination of the application and pay the relevant administrative fee,
  • neither the search carried out within the priority period nor the supplementary search carried out as part of the full examination of the application will reveal such prior art as to indicate that the subject matter of the application does not qualify for the grant of a patent.

Patents within the 24-month period will be granted only on the basis of patent applications which, when filed, do not contain any fundamental formal defects and  inventions whose patentability is not disputable.

Currently, the average time to grant a patent is between 4 and 5 years.

Charging for accelerated proceedings

There is no separate fee for the grant of a patent within the reduced 24-month period.
