Legislation, methodologies, instructions

Zákon č. 146/2000 Z. z. o ochrane topografií polovodičových výrobkov v znení zákona č. 84/2007 Z. z. (Act No. 146/2000 Coll. on the protection of topographies of semiconductor products as amended by Act No. 84/2007 Coll).

Instruction of the Industrial Property Office of the Slovak Republic Regulating the Standard Form for Applications for Topographies of Semiconductor Products

This Instruction establishes the standard format for applications for topographies of semiconductor products submitted by applicants to the Industrial Property Office of the Slovak Republic (hereinafter referred to as the "Office") pursuant to the Act (Act No. 146/2000 Coll. on the Protection of Topographies of Semiconductor Products, as amended by Act No. 84/2007 Coll.).

The topography application must contain:

  1. a request for entry into the register of semiconductor product topographies,
  2. documents enabling the identification of the semiconductor product topography, and
  3. the necessary attachments.

Application for the Registration of a Semiconductor Product Topography

An application for the registration of a semiconductor product topography must be submitted in a single copy, generally on the form issued by the Office. The application must be fully completed.
The application must contain:

  1. the applicant’s last name, first name, address, and nationality; if the applicant is a legal entity, its name and registered office;
  2. a brief description of the semiconductor product topography, limited to a maximum of 15 words; the description may consist of the name and purpose of the product in which the topography is incorporated, specifying its field of application;
  3. an explicit statement by the applicant that they are requesting registration in the register of semiconductor product topographies;
  4. the last name, first name, and registered office of the representative; if the applicant is represented by a legal entity, its name and registered office shall be stated;
  5. the date of the first, but not the first concealed, commercial use of the topography, provided that the applicant claims the commencement of protection as of that date;
  6. information regarding the acquisition of the right to protection;
  7. the signature of the applicant or their representative.

Documents enabling the identification of the topography of a semiconductor product

For the purposes of identifying the topography in paper form, two copies of drawings or photographs of the layer patterns for the manufacture of the semiconductor product, or of the masks for the manufacture of the semiconductor product, or of the individual layers of the semiconductor product numbered in the order of their manufacture, must be submitted. Details essential for identifying the topography of a semiconductor product must be distinguishable in the drawings or photographs.
Documents enabling the identification of the topography of the semiconductor product must be submitted on A4-size sheets (210 x 297 mm); however, drawings, if on paper sheets, may also be submitted in A3 format (297 x 420 mm) adjusted to A4 format. If drawings or photographs on two or more sheets are intended to constitute a single, complete drawing or photograph, they shall be arranged on the individual sheets so that a complete drawing or photograph can be assembled from them without any part of the drawing or photograph on the individual sheets being obscured.

The applicant may also submit two copies of the semiconductor product itself, or an explanatory description of the individual drawings. If the applicant exercises their right to designate any of the required documents as a trade or manufacturing secret, they must submit an additional copy of the designated documents in which the relevant parts are rendered illegible, and these documents must be marked with the letter T in the upper left corner of each page of such a document. Documents may not be designated as a whole as trade secrets.
The text portions of the application for a semiconductor product topography must be in the Slovak language.
