Information for applicants

An application for designation of origin or geographical indication shall be filed with the Industrial Property Office of the SR in writing and in one copy.

The application may relate only to one designation of origin or geographical indication.

An application for designation of origin or geographical indication may be filed by the corporation or association of producers or processors regardless of legal form or composition for product produced, processed and prepared in the specified territory.

Another natural or legal person has the right to become a member of association if he fulfils conditions of membership in association and if production, processing and preparation of the product with defined quality or characteristics takes place in the defined specific place.

An application for designation of origin or geographical indication must contain determination of the product and if the subject of application is the agricultural product or foodstuff, their specification approved by the Ministry of Agriculture of the Slovak Republic (see Articles 15, 16 of the Act No. 469/2003 Coll. on designations of origin for products and geographical indications for products).

Protection of designation of origin or geographical indication arises on the day of its entering in the register.

Duration of protection of designation of origin or geographical indication is not limited in time.

Provisions of this Act governs relations arising from designation of origin of products entered in the register before the date of entry into force of this Act provided that registered user or users fulfil registration requirements pursuant to this Act within two years time period as from the date of entry into force of this Act. The Office cancels this designation of origin after futile expiration of specified time limit.

Administrative fee of 50 EUR (the Act No. 145/1995 Coll. on administrative fees, as amended) may be remitted by a receipt or it can be transferred from the bank account of the designation holder/user into the bank account of the Industrial Property Office of the Slovak Republic IBAN: SK49 8180 0000 0070 0006 0750, BIC code: SPSRSKBA kept in the State Treasury. Every payment document must contain an account number and the variable symbol which identifies the payment. It is represented by the 10-digits numerical code as follows: 80 plus 8-digits document mark (for instance 8000282003 is variable symbol for the GI`s application no. 28-2003).
