Abstract
In this decision, the office stated that likelihood of confusion according Article 7(a) 2 Act No 506/2009 Coll. on Trade Marks exists. The office considered the high phonetic similarity even identity of the signs - JOKER ENERGY DRINK verzus JOKER and identity of the contested goods (non-alcoholic drinks) in class 32 together with low level of consumer attention as essential.
