Abstract
In this case, the office concluded that likelihood of confusion according Article 7(a) 2 Act No 506/2009 Coll. on Trade Marks doesn´t exist, however the signs were identical SALKO versus SALKO/Salko. The cumulative condition of the claimed opposition ground - identity or similarity of the goods and services wasn´t fullilled. Contested goods and services in class 9, 35, 41 and 42 versus goods and services in class 5, 16, 29 and 30 were considered as different.
